3. User Accounts

You must create an account to use Alpha Trainer. You agree to:

3.2 Account Security

4. Subscription and Payment

4.2 Payment Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • Payment processing is handled securely through Stripe

4.3 Free Trials

We may offer free trials. When the trial period ends, your subscription will automatically begin unless you cancel before the trial expires.

5. Acceptable Use

You agree NOT to:

  • Use the service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the service or servers
  • Use the service to harass, abuse, or harm others
  • Reverse engineer, decompile, or attempt to extract source code
  • Share your account credentials with others
  • Use automated systems (bots, scrapers) without permission
  • Submit false or misleading information

6. AI-Generated Content

6.1 Nature of AI Services

Alpha Trainer uses artificial intelligence to generate training scenarios, feedback, and analysis. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

6.2 No Guarantee

We do not guarantee that AI-generated training scenarios, feedback, or recommendations will result in improved sales performance or specific outcomes.

6.3 User Discretion

Users should exercise professional judgment when applying AI-generated advice and feedback to real-world situations.

7. Intellectual Property

7.1 Our Property

All content, features, and functionality of Alpha Trainer, including but not limited to text, graphics, logos, software, and algorithms, are owned by Alpha Trainer and protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

You retain ownership of any content you submit to Alpha Trainer. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide our services.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use Alpha Trainer for your personal or internal business purposes.

8. Data and Privacy

Your use of Alpha Trainer is also governed by our Privacy Policy. We collect, use, and protect your data as described in that policy.

9. Third-Party Services

Alpha Trainer integrates with third-party services (including Vapi.ai for AI calls). Your use of these services may be subject to their respective terms and conditions.

10. Termination

10.1 By You

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.

10.2 By Us

We may suspend or terminate your access to Alpha Trainer if:

  • You breach these Terms & Conditions
  • You engage in fraudulent or illegal activities
  • Your account has been inactive for an extended period
  • We discontinue the service (with reasonable notice)

10.3 Effect of Termination

Upon termination:

  • Your right to access and use Alpha Trainer will immediately cease
  • We may delete your data in accordance with our retention policies
  • You remain responsible for any fees incurred before termination

11. Disclaimers

11.1 Service "As Is"

ALPHA TRAINER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Professional Advice

Alpha Trainer provides training and educational content. It is not a substitute for professional sales coaching or business consulting.

11.3 Availability

We do not guarantee that the service will be available at all times or that it will be error-free.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHA TRAINER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

13. Indemnification

You agree to indemnify, defend, and hold harmless Alpha Trainer and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the service
  • Your violation of these Terms & Conditions
  • Your violation of any rights of another party

Continued use of Alpha Trainer after changes become effective constitutes acceptance of the revised terms.

Any disputes arising from these terms or your use of Alpha Trainer shall be resolved through binding arbitration, except where prohibited by law.
